This visa option is particularly sought after by individuals seeking employment in the US for a specific duration, often driven by a desire for international experience or higher remuneration compared to their home country.

Obtaining an H1B visa typically begins with the US employer, who must petition the US government for permission to hire a foreign worker. Detailed requirements and procedures for securing this visa are outlined in our comprehensive H1B visa article.

An additional advantage of obtaining the H1B visa is the opportunity to apply for an American Green Card, offering a pathway to permanent residency. For further information on this process, refer to our H1B to Green Card article.

However, there are intermediate steps involved in obtaining the H1B visa. Upon receiving Form I-797 or Labor Certification and approval of the USCIS petition (Form I-129) from your employer, you become eligible to apply for the visa.

Following the completion of the application and interview, the US Embassy will provide a decision on your visa status. If your application is approved and you are granted an H1B visa, the next step is to apply for visa stamping. This process entails specific procedures, which we will delve into further detail below.

Present State of H-1B Visa Stamping in India

The process for H-1B visa stamping in India remains largely similar to other countries, albeit with pandemic-induced adjustments affecting embassies and consulates nationwide.

Step-by-Step Guide to the H-1B Visa Stamping Process in India

The H-1B visa stamping process in India entails several essential steps, requiring meticulous attention to detail. Below is an outline of the key stages involved, from the initial application to the visa stamping itself:

Step 1:

DS-160 Form Completion: The process commences with the completion of the Online Nonimmigrant Visa Application, Form DS-160. Indian H-1B applicants must accurately fill out this form, providing all pertinent personal and professional information.

Step 2:

Visa Fee Payment: Applicants must then pay the prescribed H-1B visa fees, which constitute a critical component of the application process. Payment can be made through designated bank branches in India or online.

Step 3:

Appointment Scheduling: Following fee payment, applicants must schedule two appointments – one for biometric screening at a Visa Application Center (VAC) and another for the visa interview at the US embassy or US consulate.

Step 4:

Biometric Screening: H-1B biometric screening in India involves the capture of fingerprints and a photograph, serving to enhance the security of the visa issuance process.

Step 5:

Interview Preparation: Adequate preparation for the H-1B visa interview at Indian consulates is vital. Applicants should be prepared to respond to inquiries concerning their employer, job role, and qualifications.

Step 6:

Document Verification: During the interview, consulate officers will scrutinise all submitted documents, including those verifying employment, educational credentials, and USCIS petition approval.

Step 7:

Visa Stamping: Upon successful completion of the interview, the consulate officer will retain the passport for stamping. The H-1B visa stamping process concludes with the applicant receiving their passport containing the H-1B visa.
